IN THE HIGH COURT OF PUNJAB AND HARYANA

AT CHANDIGARH (Proceedings through V.C.) CRWP-11211 of 2021 Date of decision: 29.11.2021 Manpreet Singh and another ......Petitioners vs.

State of Punjab and others ......Respondents CORAM: HON'BLE MR. JUSTICE ASHOK KUMAR VERMA

Present:

Mr. Imran Farooqi, Advocate, for the petitioners. Mr. C.L. Pawar, Sr. Deputy Advocate General, Punjab. ASHOK KUMAR VERMA, J. (ORAL) Through this petition under Article 226/227 of the Constitution of India prayer has been made for issuance of a writ in the nature of mandamus directing respondents No.2 and 3 to protect the life and liberty of the petitioners from the hands of private respondents, as petitioners are in a live-in relationship.

Learned counsel for the petitioners has submitted that the petitioners met each other in a marriage function about one year back and fell in love. They decided to marry and presently in a live-in relationship. However, parents and relatives of petitioner No.2 are opposing their affair. Therefore, petitioners have moved a representation dated 21.11.2021 (Annexure P-3) to respondent No.2-Senior Superintendent of Police, Patiala, seeking protection to their life and liberty at the hands of private respondents but till date no action has been taken thereon. On the other hand, learned State counsel submits that this RAVINDER SINGH 2021.11.30 15:58 I attest to the accuracy and integrity of this document

-2CRWP-11211 of 2021 petition has been filed on false and frivolous grounds. Petitioner No.2Aman is already married and without taking divorce from her husband she is in 'live-in-relationship' with petitioner No.1. Therefore, this petition deserves to be dismissed.

Having heard the learned counsel for the parties, this Court is of the view that the present writ petition deserves to be dismissed for the following more than one reasons.

Perusal of file shows that petitioner No.2-Aman aged about 25 years is already married. Nothing has been placed on record that she has taken divorce from her husband. Without seeking divorce from her spouse, petitioner No.2 is living a lustful and adulterous life with petitioner No.1. Except for the bald allegations that private respondents No.4 to 9 are giving threat to the petitioners, no supportive material has been placed on record by the petitioners. The representation submitted by the petitioners to respondent No.2 also does not contain the allegations against private respondents No.4 to 9, much less the manner and mode of alleged threat extended to the petitioners. Furthermore, there is no valid and convincing material in the writ petition for exercising the extraordinary writ jurisdiction. In view of the above, the present writ petition is dismissed.
