Mr. Harsh Aggarwal, Advocate for the appellant. *** ANIL KSHETARPAL, J (Oral) Learned counsel representing the appellant, after arguing at some length and on being confronted with the provisions of Order 23 Rule 3A of the Code of Civil Procedure, 1908, prays for permission to withdraw the appeal with liberty to file an application before the concerned Court. In the previous round of the litigation, there were two cross suits filed by the respective parties in which they entered into a compromise. Both the suits were disposed of in terms of the settlement. The appellant filed a separate suit alleging that the aforesaid settlement is not legal. Both the Courts have opined that the suit filed by the appellant is not maintainable. Keeping in view the aforesaid facts, the appellant is permitted to withdraw the present appeal with liberty to file an application before the Court which passed the decree in terms of the settlement. All the pending miscellaneous application(s), if any, are also disposed of.
