For the reasons stated therein, the application is allowed.

LPA-226-2015:

This is an appeal against the order of the learned single Judge dated 20/02/2014 dismissing the appellant's petition.

The appellant claims that he was wrongly not promoted to the post of Salesman from his present post as a Peon. The post of Salesman was filled in by direct recruitment. 3.

Learned counsel appearing on behalf of the appellant is unable to show us any rule or requirement that compelled the respondents to fill the post only by promotion. LPA-226-2015 - 2 - respondents from filling up the post by direct recruitment. Respondent No.7 was appointed as a Salesman. We are informed that he has resigned. In the event of the respondents' deciding to fill up the post in future, it will be open to the appellant to apply for the same.

The appeal is accordingly disposed of.

As we have disposed of the main appeal itself, the delay in filing the appeal stands condoned.
