This Letters Patent Appeal is directed against the interlocutory order dated 25.07.2016 passed by learned Single Judge whereby, besides directing for provisional admission of respondent No.1 in B.A.LL.B. 5 years Degree Course (for short, `the LL.B. Course'), certain observations on merits of the case have also been made.

When this appeal came up for preliminary hearing on 17.08.2016, the following order was passed:- "

Notice of motion to respondent No.1 through Mr.H.C.Arora, Advocate, who was her counsel in the writ petition for 22.08.2016.

LPA-1473-2016 (O&M) -2order dated 25.07.2016 passed by learned Single Judge shall remain stayed till the writ petition is decided on merits except the direction for provisional admission of the respondent."

Thereafter learned counsel for respondent No.1 sought and was granted time to have instructions whether respondent No.1 is actually interested to join LL.B. Course in the appellant's Institute. Today, Mr.H.C.Arora, learned counsel states that she is not interested to seek admission in the first semester of the Course as she is already pursuing her law degree from a private Law College.

In this view of the matter, we modify the order dated 17.08.2016 and permit the appellant to fill up the resultant vacant seat(s) strictly as per merit. Since the writ petition, in which all the issues are yet to be determined by learned Single Judge, is pending consideration we dispose of this appeal, without expressing any views on merits, making the interim order dated 17.08.2016 absolute.

Disposed of.
