**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this petition for issuance of an appropriate writ, order or direction especially in the nature of mandamus directing the respondents to release the bill/payment qua the work done by the petitioner.

Learned counsel for the petitioner contends that despite completing the work according to the satisfaction of the respondents, final bill is not being released. Defect liability period has also expired.

Petitioner has already sent his claim to Sub Divisional Magistrate, Thanesar on 07.07.2021 (Annexure P-13), but the same has not been decided so far.

CWP No. 24210 of 2021 -2On the asking of the Court, Mr. Vivek Chauhan, Addl. A.G., Haryana accepts notice on behalf of respondents No.1 and 2 and Mr. Ashish Yadav, Advocate accepts notice on behalf of respondents No.3 to 5.

In view of nature of prayer made, there is no necessity of calling upon any response from the respondents at this stage, as no order prejudicial to the interest of any party is being passed.

This petition is disposed of by directing respondent No.5 to take note of Annexure P-13 and decide the same in accordance with law within a period of one month from the date of receipt of certified copy of this order.

If respondent No.5 ultimately comes to the conclusion that the petitioner is entitled for the amount in question, the same be paid forthwith within a further period of one month. In case, the amount in question is not paid within the aforesaid period of one month, thereafter, the petitioner shall be entitled to interest @ 6% per annum for the delayed payment thereafter till final realization of the amount.
