By way of instant petition, petitioner has approached this Court under Article 226/227 of the Constitution of India inter-alia for issuance of a writ in the nature of mandamus directing the official respondents to permit registration of sale deed of plot situated in the colony developed by Society-respondent No.5.

Counsel for the petitioner submits that the petitioner is a became a member of the Society-respondent No.5 and was allotted a plot. He submits that the petitioner has paid the entire consideration and a conveyance deed has been executed in her favour. By making a reference to the report of Sh. S.P.Sharma, IAS (Retd.), he submits that the petitioner has KAMAL SHARMA 2024.11.22 16:18 I attest to the accuracy and authenticity of this order/judgment High Court, Chandigarh.

CWP-20769-2023 -2been found to be a genuine member, but despite this development, petitioner is not being granted the necessary permission. He submits that the petitioner has sent a representation dated 29.01.2023, Annexure P-10, to the official respondents seeking permission to execute and register the sale deed pertaining to the said plot in favour of a third party. He submits that the petitioner would be satisfied, in case, a direction is issued to the official respondents to decide the representation.

Counsel for the respondent(s) do not have any objection, in case, such a course is adopted.
