The prayer in the present petition is under Article 226 of Constitution of India is for setting aside the impugned order dated 30.6.2025 (Annexure P-2) passed by the respondent No.1, whereby the claim of the petitioner for premature release has been rejected by deferring the case for a period of one year, despite fulfilling all the conditions of Premature Release Policy dated 12.4.2002.

The learned counsel for the petitioner contends that in view of the judgments passed by the Co-ordinate Benches of this Court in the cases of 'Pohlu @ Polu Ram Vs. State of Haryana and Ors.' in CRWP-82322022 decided on 05.02.2024, 'Raju @ Rajesh Vs. State of Haryana and Ors.' in CRWP-2160-2024 decided on 11.03.2024, and 'Shamsher versus State of Haryana and others' in CRWP-2201-2024 decided on 30.4.2024, the impugned order whereby the case of premature release of the petitioner was deferred for one year, could not have been passed. Reply by way of affidavit of Satvinder Kumar, Chief Probation Officer, O/o Director General of Prisons, Haryana, Sector 14, Panchkula has been filed by the State, which is taken on record. 4.

The learned State counsel accepts the aforementioned legal position in view of the above mentioned judgments passed by the Co-ordinate Benches of this Court.

In view of the above, the impugned order dated 30.6.2025 (Annexure P-2) stands quashed. The State of Haryana is directed to re-consider the case of the petitioner for the grant of premature release and pass an order in accordance with law, in terms of order passed by a Coordinate Bench of this Court in Pohlu @ Polu Ram's case (supra) within a period of 6 weeks from the date of receipt of certified copy of the order passed by this Court.

The petition stands disposed of.
