Today, it has been brought to the notice of the court by learned counsel for the parties that total outstanding amount, as per offer given by the petitioner on the last date of hearing after reduction of interest from 18% to 10% per annum, comes to be Rs.48,00,000/- till date and out of this amount, an amount of Rs.10,00,000/- had already been deposited with the Executing Court.

Learned counsel for the respondents submits that the respondents are ready to accept the offer given by the petitioner for the payment of residue amount of Rs.38,00,000/- in six equal installments, as observed in the last order.

In view of the terms of settlement so reached, which are agreeable to both the parties, it is observed that Rs.10,00,000/-, which has been deposited by the petitioner with the Executing Court, by way of draft bearing No. 691478, copy whereby has been placed on record, shall be released in favour of the respondents, on an application filed by the respondents, before the Executing Court.

CR-4302-2022 -2Apart from it, an amount of Rs.38,00,000/- in six equal installments shall be payable for the next six months. These intallments comes to be Rs.6.34 lakhs per month, approximately, and the same shall be paid by 15th of every month.

In the eventuality of any default made by the petitioner in payment of any installment, the petitioner shall be liable to make payment of entire decretal amount together with interest @ 18% per annum, as the present petition shall be deemed to be dismissed. Accordingly, the instant revision petition stands disposed of.
