On 21.07.2025, following order was passed by this Court:- "1.
The petitioner is claiming that respondent has prepared list of selected candidates in a stealth manner. The respondent is intentionally concealing merit list because undeserving candidates have been selected. Merit has been thrown to winds.

Mr. Shashank Bhandari, Additional Advocate General, Haryana, who on advance notice is present in Court, on behalf of respondent-State seeks time to get instructions.

Adjourned to 04.08.2025."

Written statement filed on behalf of respondents No.1 and 2 is taken on record. Registry is directed to tag the same at an appropriate

The relevant extracts of the written statement are reproduced as below:- "10. That the petitioner namely Sunder Lal s/o Lachhman Singh had applied for Band Staff recruitment against BC-B Category in Brass Band (Bass Drum instrument). In the Brass Band out of 11 posts only 01 seat was reserved for BC-B category. Brass Band having further 07 sub-category i.e. 1. Bb Clarinet 2. Bb Trumpet
3. Eb Alto Saxophone 4. Bb Tenor Saxophone 5. Tenor Trombone 6. Side Drum 7. Bass Drum.

That the total marks obtained by the petitioner during the process of recruitment of Bandsman (Constable) are 38.6 Marks (Knowledge test 13.6 Marks out of 20 Marks, PMT and PST:- Qualified, NCC Certificate- 03 Marks, Band Skills 22 Marks out of 60 Marks). The total Marks obtained by the private respondent No.3 during the process of recruitment of Bandsman (Constable) are 53.6 Marks (Knowledge test 13.6 Marks out of 20 Marks, PMT and PST:- Qualified, Band Skills 40 Marks out of 60 Marks). Total 09 candidates in BC-B category have qualified for Band skill test in Brass Band category and the private respondent No. 3 had obtained higher marks among all the candidates in BC-B category and was rightly selected by the recruiting committee being higher merit.

That both the petitioner and private respondent No. 3 got 13.6 marks each in the Knowledge test. The petitioner was also granted 03 marks maximum for his NCC Certificate. However in the band skill test the petitioner has got 22 marks (Knowledge of Scales & Instrument 10 marks out of 25 marks, Self Choice Music
-312 marks out of 25 marks, Sight Reading 0 marks out of 10 marks). The private respondent No. 3 got 40 Marks in the band skill test (Knowledge of Scales & Instrument 15 marks out of 25 marks, Self Choice Music 20 marks out of 25 marks, Sight Reading 05 marks out of 10 marks). The petitioner has obtained total of 38.6 marks overall in all process whereas the private respondent No. has obtained total 53.6 Marks overall in all process of recruitment." 4.
Learned counsel for the petitioner submits that result by way of reply has been handed over to him in the Court. 5.
Faced with the reply, learned counsel for the petitioner does not press the petition subject to liberty to avail remedies against the result in accordance with law.
