On the last date of hearing, the following order was passed: "Learned counsel for the petitioner requests for an adjournment to file an affidavit of the petitioner to the effect that the plot earlier allotted to him was not sold but had been surrendered back to the authorities concerned and that the averment made in para 3 is came to be made on account of a mistake and is factually incorrect. List again on 22.10.2024."

Today, Mr. Neeraj Jain, Advocate has put in appearance on behalf of the petitioner and has filed Power of Attorney, wherein 'No Objection' from the previous counsel is specifically endorsed, which is taken on record. 3.

The learned counsel for the petitioner however, submitted that he may be permitted to withdraw the present petition with liberty to file afresh with better particulars.
