Present petition has been filed under Section 482 of the Code of Criminal Procedure for setting aside the order dated 09.08.2022, Annexure P-3, passed by learned Additional Sessions Judge, Gurdaspur whereby his bail bonds and surety bonds were cancelled and he has been summoned through non-bailable warrants.

Learned counsel for petitioner contends that in the FIR registered against him, the petitioner had sought and was granted anticipatory bail by this Court vide order dated 17.11.2021. After presentation of challan, the petitioner having been granted bail had been regularly appearing in the Court. However, on 9.8.2022, the petitioner was unable to appear on account having fallen ill, a reference in this regard is made to the medical certificate, Annexure P-2. This fact was also informed by him to his counsel, who had also apprised the Court regarding the illness of the petitioner, however, no application for exemption was filed, leading to cancellation of his bail order, bail bonds, forfeiture of surety bonds to the

State, issuance of non-bailable warrants for 29.09.2022. Learned counsel further submits that his non-appearance before the trial Court is neither wilful nor deliberate and the same is only on account of the fact that he had fallen ill and this fact was apprised by his counsel to the Court.
