**** AJAY TEWARI, J.(Oral) This appeal has been filed against the judgment of the lower Appellate Court whereby even though the agreement to sell in favour of the appellant has been held to be proved yet the Court has also upheld the finding of the trial Court regarding the bona fide nature of the purchase made by the respondents No. 3 to 10. The trial Court had dismissed the suit in its entirety. Learned counsel for the appellant has argued that Ranjit Singh one of the vendors had admitted that he had informed the respondents No. 3 to 10 about the prior agreement in favour of the appellant when he had executed the sale deeds in their favour. Both the Courts below have disbelieved the bald statement of Anuradha 2018.03.21 10:33 I attest to the accuracy and integrity of this document
RSA No. 2980 of 2012 (O&M) Ranjit Singh. On the other hand, counsel for the appellant wants this Court to believe the testimony of Ranjit Singh. In my opinion, Ranjit Singh is hardly a credible person and even as per the appellant he is a dishonest man because, firstly he had entered into agreement to sell with the appellant and then he sold the property to the respondents No. 3 to 10.
In the circumstances, no fault can be found with the finding of the Courts below in disbelieving the testimony of Ranjit Singh. The appeal stands dismissed.
Since the main case has been decided, the pending C.M, if any, also stand disposed of.
