Pursuant to the order dated 16.10.2019, an affidavit of Shri Talwinder Singh Gill, PPS, DSP Sub Division, Sri Muktsar Sahib, has been filed by the learned State counsel, in which it has been stated that the statement of Nasib Kaur alias Jatti was recorded, wherein she has stated that she is residing alone and that the petitioner had taken a room on rent, from which and recovery of liquor was made as per the case of the investigation agency.

Learned State counsel on instructions from ASI Sukhdev Singh, who is present in Court to assist him, submits that pursuant to the order of this Court dated September 13, 2019, the petitioner has joined investigation and his custodial interrogation is not required presently. That being so, this petition is allowed, with the order dated HARPAL SINGH PARMAR 2019.12.03 12:41 I attest to the accuracy and authenticity of this document Chandigarh

Cr. Misc. No.M-39152 of 2019 (O&M) [2] September 13, 2019, granting interim bail to the petitioner made, absolute on the same terms and conditions.

However, the aforesaid order will not be treated to be an observation of this Court on the merits of the case, but only in view of the fact that the investigating agency itself has stated that it does not require custodial interrogation of the petitioner.
