***** ARCHANA PURI, J. (Oral) As per the observations made in the order dated 04.03.2025, despite service, the respondent did not make appearance on that date. Even on the subsequent date, none had made appearance. Today also, he has not made appearance. As such, the respondent is proceeded against ex parte. The counsel for the applicant heard.

The applicant-wife has filed the present application for seeking transfer of the civil suit i.e. CS/1102/2024, titled 'Jaspreet Singh Vs. Sandeep Kaur', filed by the respondent-husband, pending in the Courts at Bathinda and she seeks transfer of the same to the Court of competent jurisdiction at Moga.

It is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 22.10.2023, but no child was born from the said wedlock. On account of the matrimonial dispute, the parties are residing separate. Further, it is submitted that only for causing Sonu 2025.07.30 08:58 I agree to specified portions of this document P&HHC

TA-1007-2024 harassment to the applicant, the civil suit in hand has been filed by the respondent. The applicant is not working and as such, has no source of earning. In the given circumstances, it is submitted that it is difficult for the applicant, to commute a distance of about 90 kilometres, to defend the civil suit.

In view of the submissions aforesaid, it is pertinent to mention that on query by the Court, it is submitted by the counsel for the applicant, that even though, there is a matrimonial dispute, but the parties have not indulged into any litigation, on account of the same, except the civil suit in hand.

In view of the aforesaid fact situation and considering the fact about the respondent having not come forward to resist the application, the transfer application is allowed and the civil suit i.e. CS/1102/2024, titled 'Jaspreet Singh Vs. Sandeep Kaur', filed by the respondent-husband, stands transferred from the Courts at Bathinda, to the Court of competent jurisdiction at Moga. The requisite record of the aforesaid case be sent by the Court concerned, to the District and Sessions Judge, Moga. Learned District and Sessions Judge, Moga, shall assign the said petition to the Court of competent jurisdiction at Moga. Even, the parties are directed to appear before the concerned Court, within a period of one month from today onwards.
