-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed under Section 439 Cr.P.C. for grant of regular bail to the petitioners in case FIR No.53 dated 01.05.2021 under Section 379-B IPC at Police Station Sirhali, District Tarn Taran.
Learned counsel for the petitioners herein would contend that the petitioners have been falsely implicated in the said matter. It is contended that as alleged, six persons including two women had snatched `2500/- from the complainant and that four male persons were able to escape while the two women were apprehended. It is only on the disclosure statement of the said two women that the petitioners herein have been nominated. It is argued that the investigation has been completed and the challan stands presented. Nothing is to be recovered from the petitioners herein and therefore, their custodial interrogation would no longer be required. CRM-M No.50537 of 2021 (O&M) -2Learned counsel appearing on behalf of the respondent-State opposes grant of regular bail to the petitioner, however, she is not in a position to dispute the fact that the investigation has been completed and the challan stands presented.
I have heard learned counsel for the parties. Keeping in view the fact that the petitioners are in custody since 04.05.2021 and the investigation has been completed and challan stands presented and the fact that trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioners behind bars. The instant petition is allowed and the petitioners are directed to be released on regular bail on their execution of adequate personal/surety bonds to the satisfaction of concerned trial court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
