Versus

State of Punjab and Others ... Respondent(s) CORAM: Hon'ble Mr. Justice Mahesh Grover.

Hon'ble Mr. Justice Shekher Dhawan.

Present:

Mr. A.P.Kaushal, Advocate for the appellant(s).

Mr. Manoj Bajaj, Additional Advocate General, Punjab, for respondent No.2.

None for respondent No.3.

Mahesh Grover, J.

The writ petition, preferred by the appellants, seeking liberation from the attachment orders of the year 2000, was dismissed solely on the ground of delay and laches.

Before us, learned counsel for the appellants contended that he is willing to discharge the liability to protect their property from the coercive process of attachment. He further stated that the appellants have paid ` 4,00,000/- and are willing to pay ` 4,00,000/- more. Today, it has been brought to our notice that only an amount of ` 42,000/- remains outstanding, whereas the remaining amount has been paid as satisfaction of their liability. This fact is not controverted by learned counsel for the respondents. If that be so, we deem it appropriate to dispose Deepak Kumar Bhardwaj 2016.11.30 16:27 I attest to the accuracy and integrity of this document

Letters Patent Appeal No. 580 of 2015 (O&M) of the instant appeal as virtually having become infructuous with a direction that the appellants would now deposit the remaining amount of ` 42,000/- within a period of one month from today. Since the amount due to the respondents has been paid, the property of the appellants would stand liberated from the consequence of the attachment after the amount of ` 42,000/- has been paid by them.
