CM-3839-LPA-2016 For the reasons mentioned in the application, same is allowed. Delay of 172 days in filing the appeal is condoned. LPA-1855-2016 The appellant has laid challenge to the order dated 29.02.2016 whereby learned Single Judge dismissed his writ petition in which a direction for his appointment to the post of Supervisor/Work Mistri was sought. Learned Single Judge has dismissed the writ petition after taking notice of the fact that there is already `surplus staff' in the cadre of Supervisor/Work Mistri in the Irrigation Department and there is no vacancy available for appointment of the appellant.

LPA-1855-2016 (O&M) -2Supervisor has been sent to BBMB against Punjab Government Quota hence, the appellant can be adjusted against that vacant post. We are unable to agree with him. If there is already surplus staff, the authorities cannot be compelled to make more recruitment.
