The appellant is claimed to have been selected for the post of Peon but before appointing him, the Society resolved not to make any appointment as it was running into losses to the tune of Rs.4,76,524/- as per balance sheet as on 31.03.2015.

The appellant sought mandamus for his appointment on the ground that he has obtained information under Right to Information Act, 2005, according to which the Society is not running into losses. Learned Single Judge has turned down his claim giving rise to this Letters Patent Appeal.

We have heard learned counsel for the appellant and are of the view that mere selection does not confer any indefeasible right to seek appointment. No candidate lower in merit has been appointed. LPA-1856-2016 (O&M) -2move by the Society to appoint any one also. If the Society is running into losses, the appellant cannot compel it that he must be offered appointment. Dismissed.
