(Oral) In view of stand taken by respondent Nos.1 and 2 in short reply, the payment issue between the petitioner and respondent No.3 has already been settled and the petitioner has received the cheque in a sum of Rs.5,70,367/- from respondent No.2.

Learned counsel for respondent No.3 submits that respondent No.3 has not filed reply, but he has instructions to make the statement that petitioner has already received a PRINCE SAINI 2022.03.10 17:47 I attest to the accuracy and integrity of this document

CWP No.26282 of 2019O&M) cheque in a sum of Rs.5,70,367/- from respondent No.3 towards full and final claim. Even otherwise, the petitioner has staked his claim to the aforesaid amount for the work done by his firm. In view of statement made by learned counsel for respondent No.3 and stand taken by respondents No.1 and 2 in their written statement, this petition is disposed of having rendered infructuous. However, liberty is granted to the learned counsel for the petitioner that in case, statement of fact recorded hereinabove, is found to be otherwise or incorrect, the petitioner may move an appropriate application for revival of the present writ petition.

Disposed of accordingly.
