HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH **** LPA No.631 of 2015 (O&M) Date of Decision: 29.04.2015 **** Onkar Nath Sharma ... Appellant VS.

State of Punjab & Ors.

... Respondents **** CORAM: HON'BLE MR.JUSTICE SURYA KANT HON'BLE MR.JUSTICE P.B. BAJANTHRI ****

Present:

Mr. APS Sandhu, Advocate for the appellant **** SURYA KANT, J. (Oral) (1) The appellant assails the order dated 26.03.2014 whereby his challenge to the seniority list as Sub Inspector in the Food and Civil Supplies Department has been rejected by learned Single Judge on the ground of delay and laches. The record would reveal that the final seniority list of Sub Inspector as it stood on 31.03.1982 was circulated on 08.08.1986.

The appellant represented against the same followed by subsequent representations but the repeated representations, even if entertained by the authorities as it appears from the intradepartmental communications relied upon by the appellant, would not revive the cause of action to challenge the aforesaid seniority list through a writ petition filed in the year 2010 and that too after the appellant had retired from service. In these circumstances, the view formed by learned Single Judge not to interfere in a stale matter calls for no interference by this Court. (2) It is well settled that once the seniority list has been finalized and allowed to operate for a sufficient long period, it would not be in the administrative interest to unsettle the same. (3) Dismissed.
