(ORAL) CM-9339-C of 2019 Through this application under Order 23 Rule 1 read with Section 151 CPC applicant-respondent has prayed for dismissal of the appeal as having been rendered infructuous in view of agreement/mutual settlement dated 02.04.2019 (Annexure R-1) entered into between the parties.

Learned counsel for the non-applicant-appellant confirms that compromise (Annexure R-1) is correct. Parties have compromised in accordance with the same.

In view of above, application is allowed.
