Heard through video conferencing.

The prayer in the present Civil Writ Petition under Articles 226/227 of the Constitution of India is for issuance of a writ in the nature of mandamus directing the respondents to release the outstanding salary of the petitioner along with interest.

Learned counsel for the petitioner would contend that the petitioner was appointed as a Peon in the respondent No.5-Society in March, 1988 and since then he performed his duties with honesty and dedication. It is further the contention that the outstanding salary of the petitioner for the period from 01.04.2015 to 31.03.2021 as payable and as shown in the Head Ledger of the Society has not been released to the petitioner. Learned counsel for the petitioner would contend that in this

CWP No.24574 of 2021 -2regard a Legal Notice dated 26.10.2021 (Annexure P-4) has already been served upon the respondents, however, till date, no decision has been taken qua the same.

Learned counsel for the petitioner states that at this stage he limits his prayer and would be satisfied if a direction is issued to respondent No.5 to decide the said Legal Notice dated 26.10.2021 (Annexure P-4) in a time-bound manner.

Mr. TarunVir Singh Lehal, Addl. AG Punjab, who has joined the proceedings through video conferencing, accepts notice on behalf of respondent No.1.

In view of the limited prayer made by learned counsel for the petitioner and keeping in view the fact that the matter is not being decided on merits, the service of notices upon respondent Nos.2 to 5 is dispensed with at this stage.

Without commenting on the merits of the case, the present writ petition is disposed off with a direction to respondent No.5 to take a decision on the Legal Notice dated 26.10.2021 (Annexure P-4) in accordance with law expeditiously and, in any case, within a period of two months from the receipt of a certified copy of this order.
