The appellants have instituted this appeal against the order dated 08.08.2016 passed by learned Single Judge in CWP No.1025 of 2014 and CWP No.9498 of 2014.

Learned counsel for the appellants submits that the learned Single Judge has not correctly appreciated the ratio decidendi of the judgment of Hon'ble Supreme Court reported as UP State Road Transport Corporation vs. UP Parivahan Nigam Shishukhs Berozgar Sangh and Ors AIR 1995 SC 1115.
