Learned counsel for the appellants does not dispute that the matter is covered by the order and judgment of a Division Bench of this Court dated 12.8.2013 in a group of appeals, the first of which is LPA No.119 of 2012 (O&M) titled as State of Punjab and others vs. M/s Balak Gases Oxygen Gas Plant and another.

In view of the said judgment, the appeal is dismissed. As we have dismissed the appeal even on merits, it is not necessary to consider the application for condonation of delay in filing the appeal.
