(Oral) The present petition has been filed under Section 482 Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 seeking anticipatory bail in FIR No.11 dated 27.01.2025 under Sections 105 of BNS, 2023 (Corresponding to Section 304 IPC) registered at Police Station Nangal, District Rupnagar, Punjab. 2.

The case of the prosecution is that Vishal Bali, son of complainantJiwan Lal died due to over dose of the intoxicant injection. However, the present petition has been named on the basis of disclosure statement made by one Deepak Kumar that he has seen the present petitioner selling intoxicant injection to the deceased. The petitioner is stated to be involved in 03 more cases under the NDPS Act.

Learned counsel for the petitioner contends that the petitioner has not been named in the FIR and has been nominated on the basis of a disclosure statement. He further submits that there is no direct evidence to link the present petitioner with the alleged offence.

On the other hand, learned counsel for the State opposes the grant of bail on the ground that the allegations made against the petitioner are grave in nature and states that the petitioner is involved in 03 more cases under the NDPS Act and thus, prays for dismissal of the anticipatory bail. 5.

I have heard learned counsel for both the parties and have considered the allegations made against the petitioner. Also, the petitioner is involved in 03 more cases under the NDPS Act and as such, he does not deserve the concession of anticipatory bail.

In view of above, no ground is made out to grant the concession of anticipatory bail to the petitioner. Therefore, the present petition stands dismissed.
