**** SATISH KUMAR MITTAL, J. (Oral) Learned counsel for the appellants very fairly states that in view of decision of Division Bench of this Court in case Vijay Singh Vs. State of Haryana and others, 2011(2) SCT 340, wherein it has been held that ACP scales once granted cannot be withdrawn on the ground that an employee has forgone his promotion, as such, there is no illegality in the impugned order passed by learned Single Judge while granting the relief to the respondent employee. Learned counsel for the appellants further states that in view of the abovesaid decision this appeal be dismissed Ordered accordingly.

We hope that consequential benefits granted vide impugned order shall be released to the respondent employee within a period of four months.
