This order shall dispose of aforesaid two petitions since common questions of law and facts are involved in the same. For the sake of convenience, facts are being extracted from CRM-M-39392-2019. 2.

Both the learned counsel for the petitioners and respondent No.2 are ad idem that without expressing any opinion with regard to observations made by learned Addl. Sessions Judge, Rupnagar in para 8 of impugned order dated 07.08.2019, parties be directed to appear before the learned trial Court with liberty to raise all the pleas so available to them as were taken by them in the present petition.

Without commenting upon the merits of the case and in view of the limited prayer made by both learned counsel for the petitioner(s) and respondent No.2, the parties are relegated to appear before the learned trial Court concerned with liberty to raise all the pleas so available to them as were taken by them in the present petition. Learned trial Court is further directed to make sincere efforts to expeditiously dispose of the matter, in accordance with law. 6.
