NAMIT KUMAR J. (Oral) Prayer in this writ petition filed by the petitioner under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, quashing the order dated 26.07.2024 (Annexure P-4) passed by respondent - Corporation. Further prayer has been made to stay the recovery of Rs.2,02,297/- ordered by respondent No.1 from the salary of the petitioner.

Learned counsel for the petitioner inter alia contends that the punishment order dated 09.06.2023 (Annexure P-2) was partly setaside by the Appellate Authority vide order dated 06.03.2024, a copy of which has been supplied by learned counsel for the respondents today in the Court itself, during the course of hearing. CWP No.20949 of 2024 (O&M) Learned counsel for the respondents submits that against the said appellate order, the respondent - Corporation has filed a review application before the Appellate Authority on 27.03.2024, which is still pending consideration before the Appellate Authority. He further submits that the said review application shall be considered by the Appellate Authority, in accordance with law, after affording an opportunity of personal hearing to the petitioner. In view of the above, the present petition is disposed of. Let a final decision on the review application filed by the respondent - Corporation shall be taken by the Appellate Authority within a period of 04 months from today.

In the meanwhile, no recovery shall be effected from the petitioner till the final decision of the said review application, filed by the respondent - Corporation.
