GURBIR SINGH , J.(Oral) CM-9010-C-2023 This is an application under Section 151 CPC is moved by respondent/plaintiff for grant of permission to withdraw the suit. The counsel for the respondent-plaintiff submits that the respondent/plaintiff has no objection if judgment and decree of the appellate Court is set aside and original suit is dismissed as withdrawn.

For the reasons mentioned in the application the same is allowed. Main case Mr. Sukesh Kumar Jindal, Advocate has appeared and states that NOC has already been obtained from earlier counsel Mr. Ashwani Talwar, Advocate. The impugned and judgment decree passed by Learned Additional District Judge, Sonipat is hereby set aside and original suit is dismissed as withdrawn.
