Mr.Sanjeev Sharma, Advocate for the appellant.

SURYA KANT, J.

This Letters Patent Appeal assails the order dated 24.08.2016 vide which learned Single Judge has dismissed the appellant's writ petition challenging the initiation of disciplinary action against him by the learned District & Sessions Judge, Palwal.

His prayer to initiate suo motu criminal contempt of Court proceedings against the Judicial Officers has also been obviously declined with strong observations. During the course of hearing of this appeal, learned counsel for the appellant has very candidly submitted that he is a new entrant in the Legal Profession with hardly two years standing at the Bar and being not fully conversant with the norms of pleadings, that some undesirable averments including vindictive prayers beyond the substantive relief of quashing of Meenu 2016.11.10 11:51 I attest to the accuracy and authenticity of this document chandigarh charge-sheet, have been inadvertently made in the writ petition. Learned

LPA-2055-2016 -2counsel thus submits that should he be given one opportunity, he will withdraw the writ petition itself with liberty to the appellant to take his defence in the pending proceedings at an appropriate stage. Having heard learned counsel for the appellant and taking into consideration the above noticed submissions made by him and as prayed for, we do not express any opinion on merits and dismiss this appeal with liberty to the appellant to move an application before the learned Single Judge for suitable modification of the order under appeal with further liberty to the appellant to take his defence plea in the pending proceedings at the appropriate stage.

We are sure that the learned Single Judge would show his magnanimity and take a sympathetic view in the manner as he may deem fit. Learned counsel for the appellant further submits that he may be permitted to adopt similar recourse in two more matters which have been decided by the learned Single Judge.

Ordered accordingly.
