This petition has been filed for setting aside the judgment dated 5.3.2020 passed by the Family Court, Jalandhar, granting maintenance of Rs.8000/- per month to the respondent/wife.

Learned counsel for the petitioner contends that the petitioner husband is retired Air Force personnel, and is not in a position to pay maintenance out of the meager amount of pension he gets. Therefore, the amount of maintenance should be reduced.

Learned counsel for the petitioner has been heard. 4.

A perusal of the impugned judgment dated 5.3.2020 shows that it is established on record the respondent/wife has no source of income. She has been neglected by the petitioner, who has retired from Air Force. As per the document Ex. R3/2, he was getting pension of Rs.16,970/- per month. It is not disputed that the amount of pension must have been increased over the years. 5.

Considering admitted income of the petitioner, as also the fact that the respondent, who is his legally wedded wife, has no source of income, the amount of maintenance granted to her cannot be termed to be on the higher ASHWANI KUMAR 2023.05.08 19:11 I attest to the accuracy and integrity of this document
