(ORAL) Petitioner is an accused in a case arising from FIR No.25 dated 30.4.2017, under Section 15 of the Narcotic Drugs and Psychotropic Substances Act, 1985, registered at Police Station Cheema, District Sangrur. Allegation against the petitioner is that he was found in possession of 3 kilograms of poppy husk which is a small quantity. Notice of motion.

CRM-M-39778-2019 and thereafter, he regularly appeared except on 31.8.2019, due to the fact that there was communication gap with regard to the date of hearing. Learned counsel for the petitioner submits that given an opportunity, the petitioner would surrender before the Court of Judge, Special Court, within a period of 10 days and furnish fresh bail bond with surety of like amount to the satisfaction of the presiding Judge. Keeping in view the aforesaid facts, this Court is of the view that the present petition can be disposed of on the very first date of hearing.

The present petition is disposed of with a direction to the petitioner to surrender before the Judge, Special Court, within a period of 10 days and furnish fresh bail bond with surety of like amount to its satisfaction. This order is conditional and would enure to the benefit of the petitioner only if the undertaking submitted by the learned counsel for the petitioner is complied with. Petitioner is also required to file an affidavit that he would not remain absent from the Court except when personal appearance has been exempted in advance.
