*** ARUN MONGA, J. (ORAL) Appeal was filed way back in the year, 2019. While issuing notice of motion, following order was passed:- "Without going into the concurrent findings as returned by the Courts below dismissing the suit filed, this Court deems it appropriate to refer the parties to mediation since they are brothers.

Notice of motion.

The parties are directed to appear before the Mediation and Conciliation Centre of this Court on 01.11.2019. In the meantime, in order to explore the possibility of effective compromise, dispossession of the plaintiff-appellant is stayed till the next date of hearing."

Apropos, respondent appeared in person before the Mediation and Conciliation Centre but appellant did not appear. No mediation proceedings could, therefore, take place.

In the premise, file has been sent back to Court for adjudication on merits. None appears for appellant even before the Court. Dismissed for non-prosecution.
