**** ANOOP CHITKARA, J. (ORAL) Learned State counsel submits that the charges have been framed and as such, in this petition, the petitioner does not challenge framing of charges. Faced with this situation, learned counsel for the petitioner submits that he be permitted to withdraw the present petition with liberty to file a fresh petition in this Court.
The prayer being innocuous is not opposed by the learned State counsel. Given above, the present petition is disposed of having been withdrawn with liberty to file a fresh petition. It is clarified that the time for which the present petition was filed and is pending before this court shall be excluded from counting the period of limitation.
