*** Amol Rattan Singh, J. (Oral) By this petition, filed under the provisions of Section 439 of the Cr.P.C., the petitioner seeks the concession of 'regular bail'. Pursuant to the order dated 16.11.2019, an affidavit of Sh. Sulakhan Singh, Deputy Superintendent of Police, Sub Division Pathankot (Rural), has been filed in Court today by learned State counsel, which is ordered to be taken on record.

Learned State counsel submits that the petitioner undoubtedly having been in custody since 18.04.2019, however, upon his co-accused Simranjit Singh having been arrested with contraband (as per the case of the

Crl. Misc. No.M-39508 of 2019 prosecution), on 19.04.2019, and he having disclosed to the effect that the contraband was obtained by him from the petitioner, the petitioner, on production warrants, was taken to his home from where (again as per the case of the investigating agency), 1000 tablets of Tramadol Hydrochloride were recovered, leading to his name being added in the FIR already registered against Simranjeet Singh @ Shambhu. Without making any comment on the actual merits of the case, for or against the petitioner, looking at the circumstances here-in-above, subject to the petitioner continuing to appear before the trial Court as and when summoned, the interim order dated 16.11.2019, granting interim bail to the petitioner, is made absolute on the same terms and conditions. The petition is allowed in the above terms.
