The instant petition has been filed under Section 438 Cr.P.C., seeking the indulgence of anticipatory bail to the petitioner. 2.
In FIR bearing No. 23 of 28.1.2021, registered at Police Station City Kapurthala, District Kapurthala, offences constituted under Sections 323, 324, 148, 149, 120-B, 506 IPC, and, under Section 25 of the Arms Act, are embodied.

The learned State counsel, on instructions given to him by ASI Lakhwinder Singh, submits, that the petitioner has ensured, at his instance, recovery of a khanda, to the investigating officer concerned, and, as became used by him, in his committing an assault upon the victim 4.
The learned State counsel also submits that investigation(s), insofar as they appertain to the present petitioner, is concerned, are complete, and, after completion of investigations with respect to the incriminatory role of other co-accused, very shortly a report under Section GURPREET SINGH 2022.04.22 18:17 I attest to the accuracy and authenticity of this document Chandigarh

Therefore, given the above requisite co-operation being meted by the present petitioner, to the investigating officer concerned, and, also when the investigations insofar as they appertain to the incriminatory role of the present pettioner, is concerned, are complete. Thereupon, this Court does not deem it fit, and, appropriate to order for the custodial interrogation of the petitioner, as it would unnecessarily fetter, and, curtail his personal liberty.

Consequently, the instant petition is allowed, and, the order made by this Court on 02.12.2021, is made absolute on the same terms and conditions.

The afore observations are meant only for the disposal of the present petition, and, shall not affect the merits of the trial arising from the FIR (supra).
