Learned counsel for the petitioner points out that the challan in this case has since been presented and he may be permitted to withdraw the petition with liberty to the petitioner to avail alternative remedy available to him as per law.

In view of aforesaid, application bearing Crl.M.No.31086 of 2019 is allowed and the petition bearing CRM-M-39503 of 2019 is dismissed as withdrawn with the liberty aforesaid.
