The instant petition has been filed under Section 528 of BNSS seeking quashing as well as stay of operation of impugned order dated 01.07.2025 (Annexure P-1) passed by the learned Additional Sessions Judge, Hisar in CRA/238/2025 (appeal filed against the judgment of conviction dated 28.05.2025 in Criminal Complaint no.9-2 of 2020 and NACT 11 of 2020) titled as Satbir Saini Versus M/s Shri Somdev Khola and another, whereby petitioner has been directed to deposit 20% of the compensation amount. 2.

At the very outset, learned counsel for the petitioner submits that the next date fixed before the lower Appellate Court is 21.08.2025 and he further submits that the petitioner intends to argue the matter on the said date of hearing before the Lower Appellate Court and he undertakes that he shall not seek any adjournment.

In light of the above, the instant petition is disposed of, without issuing notice to the respondent, with a direction to the petitioner to argue the Sonia Puri 2025.07.25 18:32 I attest to the accuracy and integrity of this document

The Lower Appellate Court is also directed to hear the appeal on the date fixed and make a final decision within 15 days thereafter. In case, on the next date i.e. 21.08.2025, there are compelling circumstances to adjourn the appeal, a short date may be given to hear the final arguments. It is further directed that the condition regarding deposit of amount equivalent to 20% as engrafted in the impugned order (Annexure P-5) will be waived off till 21.08.2025. However, in case, the appeal is not argued on the next date i.e. 21.08.2025 or on any subsequent date as fixed by the Lower Appellate Court, it shall be open to the Lower Appellate Court to proceed further in accordance with law in order to enforce the impugned order (Annexure P-1).
