The instant petition has been filed under Section 528 of BNSS, 2023 for seeking quashing of impugned order dated 01.05.2025 (Annexure P3) , passed by the learned Sessions Judge, Hisar in CRA No. 196-2025 titled as "Pawan Kumar Vs. Narender and Another", whereby, while suspending the sentence of the petitioner, as awarded to him in complaint filed under Section 138 of Negotiable Instruments Act, 1881 (for short 'N.I. Act'), the learned appellate Court had directed him to deposit 20% of the compensation amount as awarded by the trial Court within a period of 60 days. 2.
At the very outset, learned counsel for the petitioner submits that hearing of the case before Ist Appellate Court is fixed for today itself. He is intending to argue the matter on the next date of hearing before the Ist Appellate Court for that he undertakes that he shall not seek any adjournment. 3.
In light of the above, the instant petition is disposed of, without issuing notice to the respondent, with a direction to the petitioner to argue the appeal on the next date of hearing before the Ist Appellate Court. HAMANT 2025.07.25 10:14 I attest to the accuracy and integrity of this document

The Ist Appellate Court is also directed to hear the appeal on the date so fixed after 22.07.2025 and make a final decision within 15 days after the hearing. In case, on the next date, there are some compelling circumstances to adjourn the appeal, a final short date may be given to hear the arguments. It is further directed that the condition regarding deposit of 20% of compensation amount as engrafted in the impugned order (Annexure P-3) shall be waived off till 22.07.2025. However, in case, the appeal is not argued on the next date so fixed or on any subsequent final date as fixed by the Ist Appellate Court, it shall be open to the Ist Appellate Court to proceed further in accordance with law in order to enforce the impugned order (Annexure P-3).
