RAJESH BHARDWAJ, J.(ORAL) Petitioners have approached this Court praying for quashing of order dated 21.12.2015, Annexure P-1, i.e. order of partition and order dated 23.09.2014, Annexure P-2, i.e. ex parte order passed against the petitioners, including all subsequent orders and proceedings in partition case No.113 of 19.11.2013 which was decided on 21.12.2015 and further issuance of writ in the nature of mandamus directing respondent No.3 to decide the partition case No.313, dated 19.11.2013, afresh after hearing and giving opportunity to the petitioners of being heard.

However, learned counsel for the petitioners prays for withdrawal of this petition with liberty to the petitioners to avail alternative remedy as available to them under the law.

Allowed as prayed for.

Petition is dismissed as withdrawn with liberty aforesaid. December 04, 2023 ( RAJESH BHARDWAJ ) meenuss JUDGE 1.
