The present contempt petition has been filed for deliberate and intentional disobedience of order dated 28.10.2014 passed by this Court in CWP-19482-2012.

This Court had issued the following directions in CWP-166412022, vide its order dated 01.08.2022:- "2.

A public authority that allows for continuance of a tenant on payment of `350/-, even after obtaining an order of eviction cannot pressforth the claims for either ejectment or for higher rent against the other tenants. The action clearly betrays an arbitrary and discriminatory conduct that falls foul of Article 14. The orders passed directing ejectment are quashed and all the writ petitions are allowed. The petitioners will pay the very same rent as another tenant viz., Kishori Lal of the VIRENDRA SINGH ADHIKARI 2025.09.26 10:21 I attest to the accuracy and integrity of this document

COCP-2717-2023 (O&M) -2building of the same size and shall be allowed to continue on the same terms as afforded to the said tenant. Any amount paid by the petitioners in excess during the pendency of the writ petition shall be adjusted against the future arrears."

Learned counsel for the petitioner contends that the petitioner had already filed a civil suit regarding the dispute in the present contempt petition, which is decreed in his favour. He, therefore, wishes to withdraw the present petition.
