NIDHI GUPTA J. (Oral) Prayer in this petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner during pendency of the trial in case FIR No. 59 dated 27.2.2021, under Sections 304-B, 498-A, 328, 34 IPC, registered at Police Station Bhiwani Khera, District Bhiwani.
Learned State counsel has filed the custody certificate dated 01.8.2023 as well as reply by way of affidavit of Logesh Kumar, IPS, Assistant Superintendent of Police, Bhiwani, on behalf of respondent-State in Court today. The same are taken on record. Learned State counsel refers to para 9 of the abovesaid reply and submits that the petitioner alongwith co-accused have since been acquitted by the learned trial Court on06.06.2023 and in support of this fact, he has placed on record copy of the order dated 06.06.2023 VIJAY ASIJA 2023.08.04 09:51 I attest to the accuracy and integrity of this document
2023:PHHC:098938 CRM-M-46156-2022 (O & M) passed by the Additional Sessions Judge, Bhiwani. Learned State counsel submits that in view of the said development, the present petition has been rendered infructuous.
Order sheet shows that there has been no representation on behalf of the petitioner on the last two dates of hearing i.e. 01.05.2023 and 07.07.2023. Even on the last date of hearing i.e. 07.07.2023, this Court had been apprised of the above facts by learned counsel for the State. However, as there was no representation on behalf of the petitioner, case was adjourned in the interest of justice. Keeping in view of the above facts, the present petition is disposed of being infructuous.
