***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Mandamus directing respondents No.2 and 3 to issue appointment letter to the petitioner and allow her to join the duties on the post of Group-D. Her name was recommended by the Haryana Staff Selection Commission. She was placed in the waiting list dated 19.01.2019 (Annexure P/7) under ESP-SC category by the respondentCommission against Advt. No.4/2018 dated 25.08.2018 (Annexure P/2). She also seeks direction to the respondent-Commission not to cancel her candidature for the post of Group 'D' for want of Sports Gradation Certificate.

Learned counsel for the petitioner submits that the petitioner was called for selection and appointment on the post of Group 'D' in the department of Animal Husbandry, Haryana and she submitted all her documents including sports gradation certificate to the respondent ASHISH 2022.10.12 13:49 I attest to the accuracy and integrity of this document
CWP-23283-2022 (O&M) -2authority. However, the objection was raised that the sports gradation certificate was issued after the closing date of filing application though the same were verified from the concerned Association and Coach of the department and were found in order.

At the outset, learned counsel for the petitioner seeks to withdraw the petition with liberty to the petitioner file a representation before the competent authority and pursue his cause. 4.
May do so within one week from today. Representation be decided as expeditiously as possible, but not later than 30 days from the date of filing.

Until the decision on the representation, the candidature of the petitioner shall not be cancelled in the ESP-SC Category on the ground that she has not produced the certificate. However, it is made clear that in case favorable certificate is not issued to the petitioner, respondent shall be at liberty to proceed, in accordance with law without seeking leave of the Court.

Disposed of accordingly.
