RAJESH BHARDWAJ, J.(ORAL) Petitioner has approached this Court praying for issuance of a writ in the nature of mandamus directing respondents No.1 to 4 to initiate departmental enquiry against respondent No.5 by considering the representation, dated 18.08.2023, Annexure P-3, for embezzling the huge funds of Narega and other funds released to Gram Panchayat Maujgarh, Block Makhu, District Ferozepur, in accordance with law. At the outset, it has been submitted by counsel for the petitioner that petitioner does not want to pursue the representation, dated 18.08.2023, Annexure P-3, qua registration of the FIR and restricts her prayer only qua carrying out the inquiry on the basis of allegations made in the complaint. Notice of motion to official respondents only at this stage. On asking of the Court, Ms.Akshita Chauhan, Deputy Advocate General, Punjab, who is present in Court, accepts notice on behalf of the official respondents/State.

After hearing counsel for the parties and going through the facts MEENU 2023.09.06 13:28 I attest to the accuracy and integrity of this order/judgment

CWP-19409-2023 -2and circumstances of the case, the present petition is disposed of with a direction to the petitioner to file a fresh representation before respondent No.2, i.e. Director, Department of Rural Development & Panchayats, Punjab, Mohali, within ten days from today, limiting his prayer to carry out the inquiry, and if he does so, then respondent No.2 would decide the same expeditiously in accordance with law preferably within one month from the date of its receipt.
