AT CHANDIGARH LPA No. 2478 of 2016 (O&M) Decided on : 08.02.2017 C.R. Yadav, HCS (Retd.) . . . Appellant
Versus
State of Haryana and others . . . Respondents CORAM: HON'BLE MR. JUSTICE AJAY KUMAR MITTAL HON'BLE MR. JUSTICE RAMENDRA JAIN PRESENT: Mr. Joginder Pal Sharma, Advocate, for the appellant. **** AJAY KUMAR MITTAL, J. (Oral) Letters Patent Appeal under Clause X of the Letters Patent Act is against the judgment/orders dated 16.11.2016 & 11.07.2016, passed by the learned Single Bench in CWP No. 13601 of 1993, titled as "C.R. Yadav, HCS (Executive Branch) Vs. State of Haryana and others". 2.
The appellant filed writ petition for quashing the seniority list dated 02.09.1993 (Annexure P-1). As per memo of parties, he is shown to be 75 years of age and had thus, retired 17 years back in the year 2000. Further, the appellant never appeared either himself or through any counsel before the learned Single Judge.
3.
In view of the above, we do not find any justification to entertain the present Letters Patent Appeal, particularly, when the appellant had already retired long time back.
4.
Dismissed.
5.
There is a delay of 130 days in filing the appeal. Since the main appeal has been dismissed, no further orders are required to be passed in the application for condonation of delay in filing the appeal and the same is left open.
