-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of regular bail in case having FIR No.124 dated 10.06.2020 registered under Sections 302, 201, 460, 34 IPC at Police Station Sadar Sangrur District Sangrur.
The counsel for the petitioner submits that the petitioner has been falsely implicated in this case and he is in custody since 10.6.2020 and is having no criminal antecedents. It is further submitted that during trial compalinant-Chamkaur Singh and his wife Sukhwinder Kaur retracted from their previous statements and due to same reason co-accused Balwinder PUNEET CHAWLA 2022.10.18 14:14 I attest to the accuracy and authenticity of this order/judgment
( 2 ) CRM-M-46073-2022 Kaur and Harinder Singh @ Harry have been granted regular bail by this Court vide orders dated 14.9.2022 (Annexure P-5 and Annexure P-6). Present petition is opposed by the State counsel but on instructions from ASI Suresh Kumar has not disputed the fact regarding grant of regular bail to the aforesaid accused vide Annexure P-5 and Annexure P-6 and further that the petitioner was arrested on 10.6.2020. I have considered the submissions made by counsel for the parties.
Co-accused Balwinder Kaur and Harinder Singh @ Harry are granted regular bail vide orders Annexure P-5 and P-6 on the ground that compalinant-Chamkaur Singh and his wife Sukhwinder Kaur failed to support the case of prosecution while appearing in the witness box. Further in the present case, the petitioner is languishing behind the bars for the last more than 2 years. In view of the above, no purpose is going to be served by keeping the petitioner in custody for any longer period. Thus without commenting on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail and surety bonds to the satisfaction of the trial Court/CJM/Duty Magistrate concerned.
