Learned counsel for the respondent has stated that the petitionerlandlord has filed an ejectment petition qua shop No.11, however, the shop in dispute is shop No.24. Learned counsel for the respondent has further stated that in view of the fact that it was a totally different shop, there was no requirement for an application under Order XXIII Rule 1 of the Code of Civil Procedure, 1908 as the ejectment petition itself pertains to a different shop. 2.
Learned counsel for the petitioner states that in view of the statement made by learned counsel for the respondent, he wishes to withdraw the present revision petition with liberty to the petitioner to avail its remedies as available in law.

Dismissed as withdrawn with the liberty aforesaid. Pending applications, if any, also stand disposed off.
