**** AJAY TEWARI, J.(Oral) This appeal has been filed against the judgment and decree of the lower Appellate Court whereby the punishment order imposed upon the respondent and terminating his services were set aside. It transpires that liberty was granted to the appellant to pass a fresh order, a fresh order has been passed and again the services of the respondent have been terminated from the same date i.e. 27.3.2003 and again the respondent has challenged the same by way of a fresh civil suit which is pending.

In the circumstances, the present appeal has been rendered infructuous. It is further clarified that the respondent would not been entitled to any benefit which may have accrued from the impugned order. Since the main case has been decided, the pending C.M, if any, also stand disposed of.
