This is the second petition filed under Section 439 Cr.P.C seeking grant of regular bail to the petitioner in case FIR No.64 dated 18.03.2019 registered under Sections 4, 16, 17 of Protection of Children from Sexual Offences Act, 2012 , Sections 363, 366-A, 342 of Indian Penal Code, 1860 and Section 3 of Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (Amended 2015) at Women Police Station Kosli, District Rewari (Annexure P-2). The first petition (CRM-M32795 of 2020) preferred by the petitioner seeking grant of regular bail was dismissed, vide order dated 14.12.2020.

CRM-M-51084 of 2021 {2} After arguing for sometime and realizing that the Court is not inclined to agree with his submissions, counsel for the petitioner does not press the petition and requests that a direction be issued to the Trial Court to expedite the trial.

Request of counsel for the petitioner has been considered. Considering that FIR is of March, 2019 and the petitioner is in custody since then, also as per information received by the State counsel from SI Manoj Kumar, victim and the complainant have been examined but some official witnesses and a doctor remain, this Court deems it appropriate to dispose of the petition and expects that the Trial Court shall make an effort to conclude the trial as expeditiously as possible.
