Apprehending threat to life and liberty at the hands of respondent No.3 & private respondents and seeking direction to respondent No.2 not to harass the petitioner, the petitioner, invoking the fundamental right of life guaranteed under Article 226/ 227 of the Constitution of India for issuance of writ in the nature of mandamus, petitioner has come up before this Court seeking protection through the State. 2.

State counsel opposes the present petition on the ground that there is nothing to fear from respondent No.3-SHO and further states that out of statutory duties, suitable action shall be taken against him by respondent No.2. 3.

At this stage, counsel for the petitioner seeks to withdraw the present petition to make fresh representation.

Given above, the present petition is disposed of as withdrawn with clarification that fresh representation be filed within 15 days from today to the SSP concerned and the same shall be decided by Superintendent of Police concerned within two months thereafter, either himself or by authorizing and delegating it to any officer holding IPS cadre. It is clarified that such order must be a reasoned order, and the same be communicated to the representationist(s) without delay.
